Occupation Certificate

The Occupation Certificate (OC) authorises the occupation and use of a new building or part of a building. There are two (2) types of Occupation Certificates that can be issued, a Part OC and a Whole OC. Only the Principal Certifier for a development can issue the Occupation Certificate.

You will be required to submit an application for an Occupation Certificate via the NSW Planning Portal prior to the OC being issued.

Part Occupation Certificate

For this OC to be issued, the incomplete building works must not pose a health and safety risk to the occupants and any Conditions specified in the Development Consent must be met. Once the final inspection has been carried out and a Final Inspection Report is provided this will list all items that are required Prior to a Part OC (PTI) being issued.

A Whole Occupation Certificate must be obtained for the whole of the building within five (5) years after the first partial Occupation Certificate is issued as required by Clause 156A of the Environmental Planning & Assessment Regulations 2000. Failure to do so will result in a Written Directions Notice being issued.

Whole Occupation Certificate

A Whole Occupation Certificate will be issued once the Principal Certifier has determined that the following has been satisfied:

  • All mandatory critical stage inspections have been carried out and are deemed satisfactory,
  • All works have been completed in accordance with the DA/CC or CDC,
  • All works have been completed in accordance with the BCA/NCC requirements,
  • All BASIX requirements have been complied with; and
  • All items listed on the Final Inspection Report have been complied with and no other items are listed as outstanding.

Interim/Final Occupation Certificate

For all DA’s & CDC’s approved/issued prior to 1st December 2019 the terms “Interim” and “Final” will still be applicable.
