Complying Development Certificate

Complying Development Certificate (CDC)

Complying development is a fast- track approval process for straight forward residential, commercial and industrial development. The development will need to ensure that it complies with State Environmental Planning Policy (Exempt and Complying Codes)2008 (Codes SEPP). If the proposal meets specific development standards, it can be assessed and determined by a council or a registered certifier without the need for a full DA.

There are various SEPP approvals you can comply with depending on the type of approval you are seeking:

  • State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 – Housing Code
  • State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 – Greenfield Housing Code
  • State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 – Demolition Code
  • State Environmental Planning Policy (Housing) 2021 – Secondary Dwellings
  • State Environmental Planning Policy (Exempt and Complying Development Codes) 2008 – Low Rise Medium Density Housing Code

Lodgement is made to your chosen Private Certifier via the NSW Planning Portal. You will be required to create an account and provide plans and documents to meet their approval criteria.

Below are the steps required to obtain the Complying Development Certificate from SBAC:

  1. Quote: Obtain a Quote. If you wish to proceed with the quote you will need to complete and sign the fee acceptance letter and return to our office.
  2. Invoice: An invoice will be provided, and full payment will be required prior to the file being assessed.
  3. Portal Lodgement: You will be required to lodge a Complying Development Certificate application through the NSW Planning Portal using the account you have already created. When uploading all of the documents it is best to upload as many as possible, however the following must be uploaded in order for the certifier to even begin assessment:

Complying Development Certificate Applicant

  • Assessment: Once SBAC has received the CDC Portal Lodgement and full payment of the Invoice one of the certifiers will assess all documents and provide you with an “Additional Information Checklist” via the NSW Planning Portal. This checklist will let you know of any further documentation that is required in order to have the CDC approved. NOTE: Please be aware that there may also be Council fees applicable, SBAC will check with Council during the assessment process and inform you of the outcome.
  • Approval: Once everything has been provided then the CDC will be approved.

 

NOTE: Even though a CDC allows you to commence construction, you will also need to appoint a Principal Certifier via the NSW Planning Portal prior to commencement of any works.
